Terms & contract information

These terms concern catering and agreed related services of HM Keskin Gastro GmbH trading as Delta Catering. Website enquiries are non-binding; services and conditions are agreed before an order is placed.

Updated: 28.10.2026

Scope & individual agreementsEnquiry, proposal & contractService scope & equipmentPrices & proposal componentsPayment & depositsGuest count, menu & changesVenue & handoverIngredients, allergens & special requirementsCancellation & postponementStatutory withdrawal rights for consumersComplaints, statutory warranty & liabilityPrivacy & applicable law

Scope & individual agreements

These terms supplement an individually agreed proposal where made available before the contract and validly incorporated. Individual agreements take precedence. Mandatory statutory rights, particularly consumer rights, remain unaffected.

Enquiry, proposal & contract

The website, menu ideas and images invite enquiries and are not a binding service offer. Sending the form does not reserve a date. Scope, date and price follow the individually accepted proposal and agreed order confirmation. Resolve open questions before commissioning.

Service scope & equipment

Food, portions, drinks, staff hours, delivery, setup, breakdown and equipment are specified separately. Only confirmed items form the agreed scope. Illustrated equipment is not a stock or model guarantee. Any provision through agreed partners and their responsibilities is addressed in the proposal.

Prices & proposal components

Prices are in euros for the services specifically agreed. Consumers receive the total payable price, including statutory VAT and known additional costs, before the contract. Delivery, staff, cleaning, hire and other additions must be identifiable. A menu photograph does not establish a package price.

Payment & deposits

Payment method, due date and any deposits or instalments are specified in the proposal before the contract. This website does not impose an automatic deposit percentage or a general advance-payment deadline. Statutory rules apply where no valid alternative agreement exists.

Guest count, menu & changes

Agree the planning headcount and deadline for final confirmation. Communicate changes to quantities, menu, time or venue as early as possible. Feasibility and any resulting scope or price changes are agreed beforehand; an enquiry alone does not amend the order.

Venue & handover

Clarify delivery, access, floors, lifts, work surfaces, refrigeration, power and water against actual needs. The parties agree who provides infrastructure, permissions and tasks. The same applies to setup, end of service, return, cleaning and any agreed breakage or loss terms.

Ingredients, allergens & special requirements

Share dietary requirements before confirming the menu. Agreed ingredients and current allergen information are decisive. Website descriptions and example images do not replace this discussion. Completely allergen-free preparation or special certification is promised only where expressly confirmed for the particular order.

Cancellation & postponement

Notify [email protected] of cancellations or postponements as early as possible. Any costs depend on valid individual agreements and applicable law. These terms set no blanket cancellation percentages. Deadlines and the treatment of services already arranged must be clear before the contract.

Statutory withdrawal rights for consumers

For distance contracts supplying food and drinks, withdrawal may be excluded under section 18(1)(10) FAGG where performance is scheduled for a specific date or period. This depends on the agreed service and does not apply indiscriminately to every service. Where a statutory withdrawal right exists, the associated information duties and consumer rights remain in force.

Complaints, statutory warranty & liability

Please report problems to the agreed contact or [email protected] so they can be investigated and, where appropriate, remedied. Asking for prompt notice does not limit mandatory statutory rights. Statutory warranty and liability claims remain unaffected; these terms contain no blanket exclusion of liability.

Privacy & applicable law

Personal data is processed as described in the privacy notice. Applicable Austrian law governs. Mandatory consumer protections and statutory jurisdictions are preserved. These terms do not impose an exclusive jurisdiction to consumers’ detriment.
